1.What Burvli is and isn't
Burvli lets you talk anonymously with other people who want to listen or be heard. It also gives you a private journal, breathing and grounding exercises, a personal safety plan, and links to professional support services.
- Burvli is peer support. Other users are members of the public. They are not trained or licensed mental-health professionals, even if they say they are, and Burvli does not check anyone's qualifications.
- Burvli does not provide medical, psychological or professional advice, diagnosis or treatment. Nothing on Burvli replaces care from a qualified professional.
- Burvli is not a crisis service. We don't monitor chats in real time and cannot send help to you. We don't know your name or location. If you need urgent help, use the crisis lines on the Support tab or call your local emergency number.
2.Who can use Burvli
To use Burvli you must:
- be at least 18 years old, or older if the law where you live requires it;
- be able to form a binding agreement, or have permission from a parent or guardian where the law requires it;
- not have been previously removed from Burvli; and
- not be prohibited from using the Service under applicable law.
3.Your account
- You need an email address and password to create an account. Give us an email address you can access, because it is the only way to recover your account.
- Keep your password secret. You are responsible for activity on your account. Tell us right away at hellowhispa@gmail.com if you think someone else has accessed it.
- One person, one account. Don't create accounts for others, share your account, or create new accounts to get around a restriction.
- Burvli gives you a codename and avatar. Don't change or use them to impersonate another person, Burvli staff or a professional.
4.Staying anonymous
Burvli works because people feel safe being honest. To protect yourself and others:
- Don't share personal details that could identify you or anyone else: full names, phone numbers, addresses, schools, workplaces, social-media handles or photos.
- Don't try to find out who someone is, ask for their contact details, or move a conversation to another platform to identify them.
- Don't record, screenshot or share another person's messages outside Burvli without their permission, except to report harm to us or to the authorities.
5.Community guidelines
Be kind, be patient and listen. When you use Burvli, you agree not to:
- harass, bully, threaten, intimidate, shame or abuse anyone;
- post hate speech, or attack people based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability, age or any other protected characteristic;
- encourage, instruct or glorify suicide, self-harm, eating disorders or violence. Talking about your own struggles is welcome. Pushing someone toward harm is not;
- send sexual or sexually suggestive content, or seek romantic or sexual contact;
- engage in any content or behaviour that sexualises, grooms or exploits minors. We report this to law enforcement;
- give dangerous advice, or present yourself as a doctor, therapist or other professional;
- spam, advertise, recruit, solicit money, or promote products, services or causes;
- use bots, scripts or automated tools, or pretend to be a human when you are not;
- share illegal content or encourage illegal activity;
- try to access accounts or data that aren't yours, interfere with the Service, probe its security, or reverse-engineer the app; or
- misuse the reporting system, for example by filing false reports.
6.Safety tools and moderation
- Leave, block and report. You can end any chat at any time, block anyone so you are never matched again, and report behaviour that breaks these Terms. Reports are anonymous: the person you report is never told who reported them.
- Reviews. When a chat is reported, our safety team may review that chat's messages to decide what to do, as described in our Privacy Policy.
- Kindness score. Your account has a kindness score that other users can see. We may adjust it based on safety reviews.
- Enforcement. If you break these Terms, we may warn you, lower your kindness score, temporarily restrict features, or suspend or permanently remove your account, with or without notice. We decide what is appropriate, taking into account how serious the behaviour is and any history.
- Serious harm. We may share information with law enforcement or emergency services where the law requires it or where we believe it is necessary to prevent serious harm.
We work to keep Burvli safe, but we can't review every conversation and we're not responsible for what other users say or do. Use your judgement, and leave any chat that makes you uncomfortable.
7.Your content
“Your content” means the messages, journal entries and anything else you submit to Burvli.
- You own your content. We don't claim ownership of anything you write.
- Permission to run the Service. You give us a worldwide, non-exclusive, royalty-free licence to store, encrypt, process, transmit and display your content only as needed to operate, secure and improve the Service. For example, we deliver your messages to the person you are chatting with, save your journal, and review reported chats. This licence ends when your content is deleted, except for copies we must keep for the reasons described in our Privacy Policy.
- We don't use your content for advertising, sell it, or use your journal or chats to train artificial-intelligence models.
- You are responsible for your content and confirm that you have the right to share it and that it doesn't break these Terms or the law.
- We may remove content that breaks these Terms.
8.Journal, exercises and resources
- Journal. Your journal is private to you. Entries are encrypted in our database and are never shown to other users or used in safety reviews.
- Safety plan. Your safety plan is stored only on your device. We can't see it, back it up or recover it.
- Exercises. Breathing, grounding and relaxation exercises are general wellbeing tools, not treatment. Stop any exercise that makes you feel unwell, dizzy or distressed.
- Third-party resources. The Support tab links to helplines, websites and services run by others, such as 9-8-8, Kids Help Phone and the Canadian Mental Health Association. We don't control them and aren't responsible for their content, availability or services. Phone numbers and links can change. We review them regularly, but please confirm details with the service.
9.Our intellectual property
The Burvli app, name, logo, design, text and software belong to us or our licensors and are protected by law. We give you a personal, revocable, non-transferable, non-exclusive licence to use the app for its intended purpose while you follow these Terms. You may not copy, modify, distribute, sell or create derivative works from any part of the Service without our written permission. If you send us feedback or ideas, we may use them without any obligation to you.
10.Ending your use of Burvli
- You can stop using Burvli at any time and permanently delete your account from Settings → Delete account. You can download a copy of your data first from Settings → Download my data.
- We may suspend or end your access if you break these Terms, if we must do so by law, or if we stop offering the Service. Where reasonable, we will tell you in advance and give you a chance to download your data.
- Sections 7 (licence for copies we must keep), 9, 11, 12, 13, 15 and 16 continue to apply after your account ends.
11.Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. These include warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, secure or error-free. We don't guarantee that you will be matched with someone, that any user will be helpful, or that any advice given by another user is accurate or safe. You use the Service and rely on anything you read there at your own risk.
12.Limitation of liability
To the fullest extent permitted by law, Burvli and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, goodwill or profits, arising from or related to your use of, or inability to use, the Service. This includes anything another user says or does. Our total liability for any claim relating to the Service is limited to the greater of CAD $100 or the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability that cannot be limited by law.
13.Indemnity
To the extent permitted by law, you agree to defend and compensate Burvli for claims, losses and costs (including reasonable legal fees) that arise from your content, your breach of these Terms, or your violation of anyone else's rights or of the law.
14.Changes to the Service and these Terms
Burvli is still growing, so features may change, be added or be removed. We may update these Terms from time to time. If we make significant changes, we will tell you in the app or by email before they take effect. If you keep using Burvli after that, you accept the updated Terms. If you don't agree, you can delete your account.
15.Governing law and disputes
These Terms are governed by the laws of the Canadian province in which Burvli is operated and the federal laws of Canada that apply there, without regard to conflict-of-law rules. If you have a concern, please contact us first. Most issues can be resolved quickly and informally. Any dispute that can't be resolved informally will be heard by the courts of that province, unless the consumer-protection law where you live gives you the right to bring a claim in your local courts.
16.General terms
- These Terms and our Privacy Policy are the entire agreement between you and Burvli about the Service.
- If any part of these Terms is found unenforceable, the rest stays in effect.
- If we don't enforce a right right away, we haven't given it up.
- You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets.
- We aren't responsible for delays or failures caused by events outside our reasonable control.
- App store terms: if you downloaded Burvli from the Apple App Store or Google Play, their terms also apply. Apple and Google are not parties to these Terms and are not responsible for the Service.
